（中央社記者游凱翔台北30日電）政治評論者周玉蔻影射前總統馬英九收受頂新政治獻金挨告，馬英九今天出庭表示，周玉蔻「口沒遮攔、恣意污衊、從不查證、毫無責任」，靠此案在節目至少賺進新台幣100多萬元。
周玉蔻民國103年指馬英九隊收頂新集團新台幣2億元政治獻金，撰文指「拿了頂新集團秘密『獻金』的，正是馬英九總統」，馬英九自訴控告周玉蔻，求償千萬元、要求登報道歉。
一審台灣台北地方法院認定「周玉蔻有相當理由確信指摘內容為真實」，判決周玉蔻無罪。
二審台灣高等法院上午開庭，馬英九以告訴人身份出庭應訊，庭末時發表聲明表示，清廉是他一生奉為圭臬的標準，但周玉蔻103年12月22日開始上各大媒體150多次，誹謗他收受頂新政治獻金，靠著在節目上談論頂新案，至少賺進100多萬元通告費。
「特偵組簽結此案後，周玉蔻仍持續的污衊我，難道這不構成惡意嗎？」馬英九表示，這件事很傷害他，且周玉蔻發言權遠遠超過他，造成兩造發言權不成比例，無法接受一審判決才提上訴。
馬英九說，周玉蔻「口沒遮攔、恣意污衊、從不查證、毫無責任」，保障人權只是一句空話，法律雖保障言論自由，但未保障濫用言論自由。
周玉蔻庭訊後接受媒體訪問表示，馬英九情緒性發言，已失去前中華民國總統高度，且將新聞工作以金錢計算，凸顯對司法的無知，馬英九在庭上的發言令人感到驚訝。1050830
